Liberation Software Licence Agreement
1. Parties and Acceptance
This agreement is between you (either an individual or a company) and Seb.ly Ltd, a UK-registered company (“we”, “us”, or “Seb.ly”). It governs your use of the Liberation software (“Liberation”).
Liberation is provided to you under a licence. Ownership of the software remains with Seb.ly.
By downloading, installing, launching, or using Liberation, you agree to these terms. If you do not agree, do not install or use the software.
2. Licence Grant
Seb.ly grants you a non-exclusive licence to install and use Liberation in accordance with this agreement.
Liberation is available under a basic licence, which allows you to download and use the software in full, except that laser and DMX output are disabled. Laser and DMX output require an additional output licence with a defined term (“licensed features”).
You may use Liberation without an output licence, but licensed features will be unavailable unless you hold a valid output licence.
The licence is personal to you and allows you to use Liberation on one or more computers you own or control, including backup machines, provided this use remains consistent with your licence.
A single output licence may only be used by one person at a time. If you allow others to use Liberation on your behalf or on systems you control, you are responsible for ensuring their use complies with this agreement.
3. Permitted Use
You may use Liberation for commercial, professional, educational, personal, and live performance purposes.
This includes use in live performances, installations, rehearsals, testing environments, and show programming.
Seb.ly does not supervise or control how Liberation is used in live or operational environments. You are responsible for ensuring that your use of Liberation complies with applicable laws, regulations, and safety requirements, including laser safety rules in your jurisdiction.
4. Restrictions
You must not sell, sublicense, or distribute Liberation as a standalone product, or present it as your own software.
You must not reverse engineer, decompile, disassemble, or attempt to discover the source code or internal workings of Liberation, nor bypass or interfere with licensing, authorisation checks, or other technical measures controlling access to Liberation or its features, except where permitted by law.
You must not use Liberation in a way that is unlawful, infringes the rights of others, or exceeds the limitations of your licence.
Liberation licence tiers are based on the scale and intended use of your laser setup. In professional, commercial, or public performance contexts, using Liberation to operate multiple lasers in a way that circumvents the limits or intent of your licence tier is not permitted, including through the duplication or splitting of output signals.
For professional use, operating each laser via its own controller is strongly recommended to ensure proper safety, control, and creative flexibility. This restriction is not intended to prevent casual or experimental use in non-commercial environments, but to ensure that professional and public-facing laser use is licensed appropriately and operated safely.
You may record Liberation output signals for archival purposes, provided it is not used for standalone playback, redistribution, or reuse in a way that replaces or circumvents the need for an active output licence.
This restriction applies while Liberation is commercially available and licensed. If Liberation is permanently discontinued and no longer available for licensing, this restriction does not apply to previously archived recordings.
5. Authorisation and Licence Management
Liberation requires online authorisation to enable licensed features such as laser and DMX output.
Authorisation requires a one-time internet connection. Once authorised, Liberation does not require an internet connection again until the output licence renews.
When you authorise Liberation, licensed features are enabled on that computer and linked to your output licence. You may authorise Liberation on more than one computer you own or control, including backup machines, up to the number allowed by your licence tier, provided this use remains consistent with your licence.
Moving licences between machines is deliberately quick and easy, provided you have access to both machines. You may need to re-authorise Liberation if you change hardware, reinstall your operating system, or move to a new computer.
Seb.ly may place reasonable limits on authorisation or licence movement to prevent abuse, but this will not affect normal use such as touring, backup systems, or hardware upgrades.
6. Intellectual Property
Liberation, including its software, code, designs, and related materials, is owned by Seb.ly or its licensors and is protected by copyright and other intellectual property laws.
This agreement grants you a limited right to use Liberation. No ownership rights are transferred, and no rights are granted except as expressly stated here.
7. Warranty Disclaimer
Liberation is provided on an “as is” basis. Seb.ly does not guarantee that Liberation will be error-free, uninterrupted, or suitable for any particular purpose.
To the extent permitted by law, Seb.ly makes no express or implied warranties, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
You are responsible for assessing whether Liberation is appropriate for your intended use and for using it safely and responsibly.
8. Limitation of Liability
To the maximum extent permitted by law, Seb.ly is not liable for indirect, incidental, special, or consequential loss or damage arising from your use of Liberation.
This includes, without limitation, loss of profits, loss of business, loss of data, and any damage or injury resulting from how Liberation is used, including, for example, damage to equipment or property, fire, burns, or eye injury caused by laser output or related systems.
Liberation is a tool for designing and controlling laser output. Seb.ly does not supervise or control how it is used. You are responsible for operating lasers and related equipment safely and in compliance with applicable laws, regulations, and safety standards.
Seb.ly’s total liability for any claim arising out of or in connection with this agreement or your use of Liberation is limited to the amount paid by you for your output licence during the twelve (12) months preceding the event giving rise to the claim.
Nothing in this agreement limits or excludes liability for death or personal injury caused by negligence, or any liability that cannot be limited or excluded under law.
9. Third-Party Software
Liberation may include third-party or open-source software components.
Use of those components may be subject to additional terms. Any required notices or licence texts are provided with Liberation or are available on request.
10. Term and Termination
This agreement takes effect when you first install, launch, or use Liberation and continues while you are permitted to use the software under this agreement.
Your right to use licensed features ends automatically when your output licence expires, is cancelled, or is otherwise no longer valid.
Seb.ly may suspend or terminate your output licence if you materially breach this agreement. Where practical, you will be given an opportunity to remedy the breach.
Upon termination of your output licence, you must stop using licensed features. Some parts of this agreement are intended to continue to apply even after it ends, and will remain in effect.
11. Governing Law and Jurisdiction
This agreement is governed by the laws of England and Wales.
Any dispute arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Entire Agreement and Severability
This agreement constitutes the entire agreement between you and Seb.ly regarding Liberation and supersedes all prior or contemporaneous agreements or understandings relating to the software.
If any provision is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
